According to press news, the notion of pending cases in the Portuguese courts will be “negotiated” with the troika. This is quite misleading and inaccurate. There is a clear need to distinguish between pending cases and backlog cases, as deciding a case cannot be instantaneous, which leads to a “normal waiting time”. Only when this “normal waiting time” is exceeded, on average, we should concerned. The importance of a precise definition of concepts should be underlined, and it is not a portuguese feature.
